Can you use Higgsfield for client work and paid ads? What the Terms actually say

Yes: Higgsfield doesn't own your outputs, doesn't limit commercial use, and lets you hand the rights to a client. The catches that matter to agencies and brands are training, exclusivity and who carries the legal risk.

If you make ads for clients, or run creative for a brand, the question isn't "can I post this on Instagram". It's whether you can sign a contract that hands the client the rights, whether the client's product photos end up training someone's model, and who pays if an ad turns out to copy something. We read Higgsfield's Terms of Use (last updated October 23, 2026) and its business-plans help page on November 3, 2026. Everything in quotes below is copied from those pages. This is a plain reading, not legal advice.

Can you use Higgsfield videos and images commercially?

Yes, on every plan. Section 4.4 of the Terms says: "Company does not claim ownership of any of your Inputs or Outputs, nor does it restrict your commercial use of Outputs." Higgsfield's help center adds that commercial use isn't sold separately, so a free or Starter account has the same rights to its outputs as Ultra. What changes between plans is credits, models and queue, not the license. One practical difference: the help page notes that watermarks on a plan that adds them "are embedded at generation", and "Paid plans include watermark-free downloads." For client deliverables, generate on a paid plan (more in our watermark guide).

Can an agency hand the rights to its client?

Yes. The same section says "you may transfer or sublicense your rights in Outputs to your clients or other third parties." That is the sentence an agency contract needs: you generate the ad, then assign or license it to the brand. Write the handover into your client contract the same way you would for stock footage you licensed.

What happens to client work if you cancel Higgsfield?

The rights stay. Section 4.4: "Your rights in Outputs you have generated and exported survive cancellation of your subscription or deletion or termination of your Account". Note the word "exported". Files that only live in your Higgsfield library are a storage question, not a rights question: the Terms (s.3.4) let Higgsfield move old content to cold storage, and inactive accounts can be migrated after 30 days. Download every deliverable before you cancel, or before a client project closes. Our cancel and refund guide covers the cancel steps.

Does Higgsfield train its AI on client footage?

Yes, unless you are on Enterprise. Section 4.4: "You acknowledge and agree that Your Content, Inputs, and Outputs may be used by Company to train, develop, enhance, evolve, and improve its (and its affiliates') AI models, algorithms, and related technology, products and services." The exception follows straight after: "under those agreements, Company does not use the customer's content to train or improve its AI models, and that content is handled as confidential." Those agreements are Enterprise agreements. There is no per-account opt-out switch; the Terms say you can stop future use by deleting the content or the account, which does not undo training that already happened. Our Higgsfield privacy guide has the full detail on uploads, providers and deletion.

For an agency, the practical rule: don't upload a client's unreleased product shots, logos or footage to a Team or Scale workspace unless the client contract allows it.

Only Enterprise. Higgsfield's own business-plans table lists "No data training" and "SOC 2 and legal indemnification" as No for Team, No for Scale and Yes for Enterprise.

Is the output exclusive to you or your client?

No. This is the clause most agencies miss. Section 4.4: "Outputs generated by the Service may not be unique across users. Other users may receive an Output that is similar or possibly identical to yours. Company does not guarantee the uniqueness, originality, or exclusivity of any Output." If a client contract promises exclusive, one-of-a-kind creative, you can't back that promise with the Terms alone. Use the brand's own product photos and footage as inputs and edit the result, and word the contract as a license to the delivered files, not a guarantee that no similar image exists anywhere.

Will Higgsfield use your client's ads in its own marketing?

Not without your consent, unless you publish them on Higgsfield. Section 4.4 limits marketing use to content you made public on the service, such as the community page, a contest or a showcase, or content you consented to, and adds: "Company will not use your private content, or private content you create for or on behalf of a client, in its marketing without your consent." Keep client work private and out of contests.

Who is liable if an AI ad infringes someone's rights?

You are. Section 12 of the Terms says you will indemnify Higgsfield against losses arising from your content or your use of outputs "to the extent arising from content you provided without the necessary rights or from your use of the Service in violation of this Agreement or applicable law", plus any violation of another party's rights. Section 4.2 also makes you promise you have the rights and consents for any names, likenesses and voices you upload. Legal indemnification from Higgsfield only appears on the Enterprise plan. For client work that means: get written permission for any real person's face or voice, don't put competitors' logos or trademarks into prompts or reference images, and pass the same promises through to your client contract.

Do you have to label Higgsfield ads as AI?

Where the law requires it, yes. Section 5.5: "Where required by applicable law, you will disclose that Output is artificially generated or manipulated, and you will not remove, alter, or obscure any provenance signals or markings". Section 6.4 says Higgsfield may embed watermarks, metadata or C2PA-style "Content Credentials" so outputs can be identified as AI-generated, and that those marks may be invisible. Ad platforms also have their own AI-content labels, so check the rules of the platform you buy ads on, and the market you run them in, before launch. Our page on YouTube's altered or synthetic content label covers one platform in detail.

What should an agency put in its client contract?

A short checklist, built from the clauses above:

  • Rights: you license or assign the delivered output files to the client, as allowed by Higgsfield Terms s.4.4.
  • Inputs: the client confirms it owns the product photos, logos and footage it sends you, and has consent for any person shown.
  • Training: say whether client material may be uploaded to a non-Enterprise workspace, where it may be used for model training.
  • Exclusivity: no promise of uniqueness beyond the delivered files.
  • Disclosure: who adds AI labels where a platform or law requires them, and that provenance marks won't be stripped.
  • Archive: you export and hand over final files at delivery, so nothing depends on your Higgsfield subscription.

Which plan should an agency or brand team use?

  • One person making ads for a few clients: an individual plan is enough for rights. Pick by credits: our plans compared page does the maths.
  • Two to nine people sharing credits and assets: Team. Note that workspace admins can access members' content, so client work isn't private from admins.
  • Higher volume, SSO or spend controls: Scale.
  • Client contracts that forbid training on their material, or need SOC 2 and indemnification: Enterprise, through Higgsfield's sales team.

Quick answers

Can I use Higgsfield videos in paid ads?
Yes. Higgsfield's Terms of Use (s.4.4) say it does not restrict commercial use of outputs, on any plan.
Can I sell or hand Higgsfield output to a client?
Yes. You may transfer or sublicense your rights in outputs to clients or other third parties (s.4.4).
Do I lose the rights if I cancel Higgsfield?
No, for outputs you generated and exported. Those rights survive cancellation or account deletion (s.4.4). Download files before you cancel.
Does Higgsfield train on my uploads on the Team plan?
Yes. Only an Enterprise agreement excludes your content from training; Team and Scale are listed as No for no data training.
Is Higgsfield output exclusive?
No. The Terms say outputs may not be unique and Higgsfield doesn't guarantee exclusivity.
Who is responsible if an AI ad infringes a trademark?
You are. Under s.12 you indemnify Higgsfield; legal indemnification from Higgsfield is an Enterprise feature.

What is Higgsfield Katana, and can it remake a client's video edit?

Katana is Higgsfield's video-edit remixer that runs inside Claude. You give it a reference edit (your own video or a preset) and up to five photos of a person, product or outfit, and it rebuilds the edit with them in it. It needs a paid Higgsfield plan, it always spends credits, and Unlimited doesn't cover it. Here is what Higgsfield documents, what an agency remaking a client edit needs to know, and what Higgsfield doesn't say.
